Welcome to my website, julieswinsco.com. I want buying my work to feel as enjoyable and straightforward as possible, so here’s a plain-language overview of my Terms.

  • Originals & Prints
    You can buy original framed artworks or limited edition Giclée Prints directly from me, via this website, or through authorised galleries. Prints are supplied mounted and ready for you to frame. Each piece is signed and comes with a Certificate of Authenticity.

  • Copyright
    Even when you buy an artwork or print, I retain the copyright. That means you own the physical piece, but you can’t reproduce or copy it for resale or commercial purposes.

  • Returns
    If you buy online, you have a 14-day cooling-off period under UK law. Artworks must be returned in their original condition and packaging. You cover return shipping unless the piece is faulty or misdescribed.

  • Delivery
    Delivery times depend on the type of work and destination. I make sure all pieces are carefully packaged and shipped. Risk passes to you when the item arrives, but ownership transfers only once payment clears.

  • Commissions
    I’m happy to take on commission work. A non-refundable 50% deposit is required to start, with the balance due when it’s finished. I retain copyright in all commissioned works.

  • Resale
    You may resell a piece you’ve bought, but it must always be attributed to me as the artist. Artworks must not be altered or reproduced without my written consent.

  • Galleries & Consignment
    Some works are available through trusted galleries. In these cases, both my Terms and the gallery’s terms may apply. Consignment sales mean ownership passes to you only once full payment has cleared.

  • Legal
    All sales and website use are governed by UK law. Any disputes will be handled by the English courts, or optionally through arbitration if both parties agree.

Terms and Conditions

These Terms and Conditions (“Terms”) govern all sales and use of the website julieswinsco.com (“Website”). By accessing this Website or purchasing artwork, prints, or services — whether directly from Julie Swinsco, Artist, through this Website, or via an authorised gallery, exhibition, or consignment arrangement — you agree to be bound by these Terms and by UK law.

1. Definitions

  • “Artist” means Julie Swinsco, Artist.
  • “Website” means julieswinsco.com.
  • “Artwork” means original paintings, drawings, mixed media, or digital works created by the Artist.
  • “Prints” means Fine Art Giclée reproductions or other editions produced by or for the Artist.
  • “Customer” or “Buyer” means any person purchasing Artwork, Prints, or services directly from the Artist, via this Website, or through an authorised gallery, exhibition, or consignment arrangement.
  • “Galleries” means independent third-party venues or online platforms authorised to exhibit or sell the Artist’s work.

2. Use of Website

  • The Website and all content, including text, images, and artwork, are the intellectual property of the Artist and may not be copied, reproduced, or used for commercial purposes without prior written consent.
  • You may view, download, and print content for personal and non-commercial use only.
  • The Website may contain links to third-party websites (such as social media, payment providers, or galleries). These links are provided for convenience only, and the Artist accepts no responsibility for their content or practices.
  • You must not misuse the Website by knowingly introducing viruses, trojans, worms, or other malicious material. Unauthorised access attempts will be reported to the relevant authorities.

3. Sales of Originals and Prints

  • All sales of original Artwork and Fine Art Giclée Prints are final, subject to statutory rights under UK consumer law.
  • Originals are supplied framed (unless otherwise specified).
  • Giclée Prints are limited editions of 50, hand-signed by the Artist, supplied with a Certificate of Authenticity, and mounted ready for you to frame in your choice of frame.
  • Prices listed on the Website or in exhibitions are inclusive of VAT (where applicable) but exclusive of shipping, unless otherwise stated.

4. Sales via Galleries and Exhibitions

  • The Artist’s work may also be exhibited and sold through authorised galleries or exhibitions.
  • In such cases, the gallery’s own terms of sale will apply in addition to these Terms.
  • Regardless of the point of sale, copyright and attribution remain with the Artist.

5. Consignment Sales

  • Where Artwork is consigned to a gallery or third-party seller, ownership transfers to the Buyer only upon full payment being received by the Artist (either directly or via the gallery).
  • Customers purchasing through a consignment gallery remain entitled to the authenticity, quality, and copyright protections described in these Terms.

6. Copyright and Reproduction Rights

  • © Julie Swinsco. The Artist retains the sole copyright and all moral rights to her original artworks and Prints.
  • Purchasing an Artwork or Print does not transfer copyright.
    Any unauthorised reproduction, duplication, or commercial use violates copyright law.
  • The Artist reserves the right to create and sell printed reproductions of her original works, unless otherwise agreed in writing.

7. Delivery and Shipping

  • Delivery times vary depending on the artwork type and destination.
  • Prints are typically shipped flat-mounted; originals are shipped framed unless otherwise specified.
  • Risk in the goods passes to the Buyer upon delivery; title transfers only upon receipt of cleared funds.

8. Returns and Cancellations

  • Customers purchasing online from the Website are entitled to a 14-day cooling-off period under UK distance selling regulations.
  • Returns must be made in their original condition and packaging.
  • Return shipping costs are the responsibility of the Buyer unless the item is faulty or misdescribed.

9. Resale of Artworks

  • Buyers may resell artworks purchased from the Artist; however, artworks must not be altered, misrepresented, or reproduced without prior written consent.
  • The Artist asserts her right to be properly attributed as the creator whenever works are displayed or resold.

10. Commissions

  • Commission work may be undertaken by prior agreement.
  • A non-refundable deposit of 50% is required to commence commission work, with the balance payable upon completion.
  • Commissioned works remain the intellectual property of the Artist, and copyright does not transfer to the commissioning party.

11. Warranties and Limitations of Liability

  • Giclée Prints are produced to gallery-standard quality using archival, acid-free papers and pigment-based inks designed to last 100+ years.
  • While every effort is made to ensure accuracy of colour and reproduction, slight variations may occur between the digital image displayed and the finished print.
  • The Artist makes no warranty that artworks will be free from minor imperfections consistent with hand-made and hand-finished processes.

12. Governing Law and Jurisdiction

  • These Terms are governed by and construed in accordance with the laws of England and Wales.
  • Any disputes shall be subject to the exclusive jurisdiction of the English courts.
  • Optionally, disputes may be resolved through binding arbitration before litigation, if mutually agreed.
